Consumer Alert News For Guardians

Manufacturer's liability is a legal concept that holds sellers and manufacturers liable for damages that their defective products cause. In other words, people who sustain injuries from such items may be entitled to fair compensation from the responsible parties for their wounds. It can prove to be a mistake to try and take on large corporations alone. They usually have lawyers on retainer, waiting for certain situations to arise. Those professionals only have one goal: prevent their clients from having to shell out large amounts of cash for restitution.

Sometimes, a company’s legal team offers small settlement sums in the beginning. When victims don't know any better, they often agree to the terms, assuming that they won't get a more substantial deal. However, many times, they find out that the money won't cover their recovery costs. Not to mention, it will probably not make up for the wages they lost because of the incident. These attorneys even attempt to bend the truth to make it look as if the victims did something wrong, leaving them feeling as though they are on trial.

On occasion, the lawyers of manufacturers have been known to include fine print in contracts that says the injured party signs their rights to compensation away. Such documents typically do not hold up in a court of law. Still, that delay tactic can bring the negotiations and proceedings to a screeching halt.

A Consumer Alert Warning For Parents With Young Children

Parents who want to keep their little ones safe should pay close attention to this information. After all, most of them only want what's best for their kids, and they do not wish to see anything terrible happen to them. FlyBar of Freehold, New Jersey has begun recalling approximately 3,000 Swurfer Kiwi Baby and Toddler Swings. The units were sold at various stores across the nation from October of 2019 to March of 2020. Plus, they were available online at Amazon.com, Walmart.com, FlyBar.com, and Swurfer.com.

The swings came in the shades of green, pink, and blue. Persons who believe they own one of these items should check the underside of the device—products involved in this recall will have FlyBar, Inc. and Kiwi Swing SSW-0005 printed there. Also, an August 2019 manufacturer date code can be found on the back of the swing. FlyBar has received six complaints about the rope ends detaching. Thankfully, no injuries have been reported as of yet, but that could change in the blink of an eye as this product poses a fall hazard.

It is recommended that people discontinue the use of these swings immediately. They will also want to contact FlyBar to receive instructions on how to repair them. However, if your child sustains severe injuries on a swing from no fault of their own, just know that top-notch legal representation is only a phone call away.

Client Testimonials

Attorney David Goldman has been exceptional in the process of helping me through the case. He has always been easy to reach, whether by phone or email, and has thorough knowledge and explains clearly in depth so you feel safe and confident in your lawyer

I used Michael Babboni and his paralegal, Nicole Moore for a legal matter. They went above and beyond my expectations. During the entire process there was constant communication with both Michael and Nicole. They were extremely organized and on top of my case, which I am very grateful for. Michael truly had my best interests at heart and he was very genuine. I plan on referring Michael to all family and friends and will continue to use him in the future.

I dealt most with Mr. Fernandez. I didn’t know a lot about this process. He took the time to speak with me individually, in person, to explain everything. It was very helpful to actually know and understand the process and what to expect. He closed my case quickly, which was nice that it was not prolonged! I appreciated his hard work and getting me what I felt I deserved after my car accident. I highly recommend him to anyone who needs an honest and reliable lawyer to assist you with your case!

I hired Mr. Walsh after an automobile accident this past March. He and his entire staff were extremely professional. They kept me informed every step of the way and settled my case in a timely manner. Thank you so much for your help.
