Everything You Need To Know About The Newest Toyota Recall

2016 has been a rough year for Toyota. From the Takata airbag safety issues, to issues from problems with sensors, seat belt mounts, and shock assemblies, there have been a quite a few recalls for this popular vehicle manufacturer. On August 12, Toyota announced another recall, this time affecting the RAV4 SUV and the Lexus HS250h sedan.

Toyota Recall Details

The recall will impact 337,000 vehicles and includes the Toyota RAV4 SUV made between 2006-2011 and the Lexus HS250h sedan made in 2010. These same vehicles have been recalled three times so far for suspension issues. The first recall occurred in 2012 as a result of a wobbly rear suspension. Then in 2013 they were recalled to adjust the rear wheel alignment. Now Toyota has discovered that rust can form on the suspension arm threads if the nuts on the rear alignment are not tightened correctly. If the nuts are not tightened correctly, the arm can separate from the vehicle, causing the driver to lose control.

Toyota is voluntarily recalling the vehicle and notifying vehicle owners by mail. If you have one of the recalled vehicles, you will be instructed to take it to the Toyota dealership and they will replace both rear suspension arms at no cost to you. They will also apply an epoxy to prevent future arm adjustment when the suspension is being serviced. To learn more information about the recall, check out Toyota’s website at:

Recalls And Product Liability

If you own one of these recalled Toyota vehicles and get into an accident, it’s important to know your rights. When manufacturers recall vehicles, you have a responsibility to pursue the recall and have the vehicle fixed after the date of notification. However, consumers are not always properly notified about recalls or may even experience an accident before a recall was issued. In these circumstances, you may have a case for product liability against the vehicle manufacturer, parts manufacturer, or car dealer.

What Do If You Are In An Accident With A Recalled Vehicle

If you own any of these recalled Toyotas, or any vehicle that has been recently recalled, and have been in an accident, there are some steps you need to take. As soon as the accident happens you need to have a mechanic inspect the vehicle to see if it is connected to the recall. If the accident happened before the recall was issued, you can have an expert look at the accident report and have a mechanic inspect the vehicle to see if there is a correlation between your accident and the recall. If you think your accident is a result of a mechanical failure or recall, it is extremely important to hire a personal injury attorney because they have the resources to prove that the incidents are related. Once you have proven the accident is related to the recall, you can pursue a claim.

Pursuing a product liability claim in the face of a vehicle recall is very difficult. Car manufacturers have teams of high-powered attorneys and will try to get out of paying a fair settlement for your injuries.
