How Far Will Insurance Companies Go To Block Claims? Just Look At This Case

If you are involved in a personal injury or wrongful death case, you’ll soon find out that insurance companies will go to great lengths to avoid paying out any claims.

This unfortunate truth has been demonstrated again and again over many years in Florida. Unfortunately, insurance companies rely upon legal maneuvering to protect their profit.

Many insurance companies spend millions of dollars each year trying to undermine the claims of their own clients. Compared to the amount that they might stand to pay out in claims, they may save only a few hundred dollars in some of these cases.

Nevertheless, they are willing and able to fight — and a recent case has shed light on just how far some insurance companies may go when it comes to personal injury and wrongful death cases.

Hillsborough County Is Planning To Sue Star Insurance Co. Over Wrongful Death Settlement

Four years ago, a 39-year-old Hillsborough County native and nurse was killed after her car plowed into a disabled Hillsborough County vehicle. The woman’s death resulted in her three children being left without a mother.

Since that time, Darcia Dominguez’s family has worked hard within the court system to get a settlement. And recently, lawyers for Hillsborough County concluded that they might get it.

Naturally, the County has been fighting the settlement. However, County lawyers recently determined that it may be in the County’s best interest to go forward with a settlement, which may total up to $2 million.

There is just one problem: The County’s insurance company.

You might think that one of Florida’s most prosperous and populous counties would be the kind of entity that an insurance company would be unwilling to trifle with.

Unfortunately, the County is now alleging that Star Insurance Co. has been engaging in behavior that has prevented talks about the potential settlement from going forward.

Naturally, the insurance company has a significant monetary interest in the case.

How Does An Insurance Company Take On A Major Florida County?

Star Insurance Co. was a provider of auto insurance for Hillsborough County back in 2010, when the accident took place. The liability limit on that insurance was reported at $2 million.

Hillsborough trial attorney Stephen Todd has reportedly stated that “… the statute is pretty clear, and we can go ahead and settle,” but Star is blocking the settlement — which could take months or even years to untangle.

This is an extreme case, but it is not the only case of its kind. Insurance companies are often some of the most highly profitable businesses in our society. They protect that profit largely by paying out as few claims as possible.

Very few insurers will go as far as Star Insurance Co. is alleged to have gone in this case. However, it’s also unusual for insurers to honor a claim immediately, without launching a full-scale investigation beforehand.

That’s why, when it comes to insurance claims, you are always better safe than sorry.
