How Much Time Do I Have To Start A Personal Injury Case?

How Much Time Do I Have To Start A Personal Injury Case? When you sustain a serious injury, the most important thing you can do for yourself and your family is concentrate on recovering. Before anything else, your own health and welfare is the very first thing you should focus on maintaining. After that, however, you should think about how the injury happened, and, if someone else is responsible, what you can do to receive compensation for an unfair and potentially debilitating act.

Of course, any number of things—including your own recovery—can take significant amounts of time. Sometimes even years can pass before you can turn your thoughts back to proper compensation for the suffering you have received. But does there ever come a time when, after deciding that maybe it’s time to properly collect damages for a serious injury it may be too late to do so?

The answer to that is yes. And it is called the “Statute Of Limitations,” which varies depending on the case and circumstances.

The Clock Is Ticking

Simply put, the statute of limitations means that people wishing to pursue some kind personal injury or negligence case have a limited time to do so. You cannot sustain an injury as a child and then decide years later after getting married and having your own family that you would like to sue the amusement park where the accident occurred over 30 years ago. The statute of limitations ensures that any injury you sustain must be relatively recent, and have a significant, negative impact on your quality of life, in order to constitute grounds for a case.

When it comes to conventional injuries, such as those sustained by car accidents, slips and falls, or animal attacks, the normal period of time in which a personal injury case can be filed is up to four years. One of the reasons for this is injuries—or their long term, debilitating effects—may not always be immediately apparent. If you sustained a muscular injury in a car accident for example, the injury itself might only worsen with gradual usage of your limbs, and only really impact your life several months after the incident. So even if you think you were fortunate in escaping from a crippling accident with only minor injuries, in actuality the true extent of your injuries may have simply been delayed. The statute of limitations makes sure you still have options available to you even after the accident has occurred and you are out of the hospital.

The same is true for product liability related injuries. In this case, product liability means that the injury was sustained due to using a defective product. This encompasses a broad suite of injuries from escalators not working correctly to air bags in automobiles not inflating when they should to electronics causing fires in homes. In these cases, as with normal injuries, you have up to four years to file your case.

The statute of limitations is there to protect you from the delayed reactions of some injuries. If you’d like to more know about how it works, contact the Lawyers of Goldman Babboni & Walsh. Client Testimonials

Attorney David Goldman has been exceptional in the process of helping me through the case. He has always been easy to reach, whether by phone or email, and has thorough knowledge and explains clearly in depth so you feel safe and confident in your lawyer

I used Michael Babboni and his paralegal, Nicole Moore for a legal matter. They went above and beyond my expectations. During the entire process there was constant communication with both Michael and Nicole. They were extremely organized and on top of my case, which I am very grateful for. Michael truly had my best interests at heart and he was very genuine. I plan on referring Michael to all family and friends and will continue to use him in the future.

I dealt most with Mr. Fernandez. I didn’t know a lot about this process. He took the time to speak with me individually, in person, to explain everything. It was very helpful to actually know and understand the process and what to expect. He closed my case quickly, which was nice that it was not prolonged! I appreciated his hard work and getting me what I felt I deserved after my car accident. I highly recommend him to anyone who needs an honest and reliable lawyer to assist you with your case!

I hired Mr. Walsh after an automobile accident this past March. He and his entire staff were extremely professional. They kept me informed every step of the way and settled my case in a timely manner. Thank you so much for your help.
