Important Notice: Ford Motor Company Recalls 40,000 Vehicles

On November 19, 2018, Ford Motor Company recalled 40,000 vehicles. 2018 Ford explorer vehicles with a 2.3 or 3.5-liter GTDI engine have a misassembled fuel pressure sensor. This sensor may lead to a fuel leak, increasing the risk of the vehicles catching on fire. 2019 Ford Super Duty vehicles have been recalled for a casing around the transmission that can cause the vehicle to move in park rising injury. 2018 Ford Expeditions and Lincoln Navigators are being recalled because their seat tracks are missing brackets, increasing the risk of injury.

Ford requests owners of these vehicles take them to the nearest Ford Dealer to have the fuel line replaced.

What Is An Auto Recall?

An auto recall is when the National Highway Traffic Safety Administration’s (NHTSA) or the manufacture of a certain style or several styles of car does not meet safety standards of the Federal government. The safety issues are considered an “unreasonable risk to safety”. This includes parts, seats, and tires among others. When your car is recalled you will receive a notification that contains the following:

● It will describe the defect or why the vehicle is non-compliant with safety standards

● A warning of the risk or hazard that is a result of the problem

● A brief description of where you can take your car for repair free of charge, how long the repair will take and what will be done to correct the issue.

● An explanation if the defect is safety-related or non-safety related. Safety-related include issues with steering, fuel systems, accelerator controls, defective tires, etc. Non-safety related refers to items such as air conditioning, paint issues, radio and so on.

What Happens if I Have an Accident Before I get a Recall Notice?

If you have no knowledge of a recall on your vehicle and it is a safety-related issue you do have options. There is a good chance that the accident and your injuries were caused by the defect even if you are responsible for the accident.

It is important that it has been determined that the accident has been caused by the defective part. If this is the case you do have a case of contributory negligence or product liability. Some of the more common auto recall issues that if left unattended can cause an accident or injury include:

● Airbags that do not deploy. They can cause injury if they do not deploy or if they deploy too fast can make the situation worse.

● If the seat back breaks and fails to hold you and protect you.

● Seat Belts that do not work properly.

● Roofs that collapse if you are in a rollover crash.

● If the electrical systems are defective and result in a fire

● The car accelerates unintentionally.

● The brakes fail to engage

● The power steering fails leaving the driver with no control over the steering

● Tire failure

It goes without saying that if you are going to go up against major corporations such as an automobile manufacturer, you should not go it alone. The first step you should take after making sure your injuries are taken care of and your passengers are okay is to call an attorney.

Do I Need an Attorney?

It is not only strongly suggested that you obtain services of an attorney, but obtain the services of an attorney who is well versed in motor vehicle defects. When you meet with an attorney you need to bring all medical bills, police reports, other bills and any and all information you can obtain on your make and model of car. He will then file a product liability lawsuit. The lawsuit states the following:

● The car manufacturer has a duty to create a safe vehicle for consumer use

● That he neglected his duty by manufacturing a vehicle that is defective and therefore dangerous.

● The defect of the vehicle was the direct cause of the accident

● The accident resulted in harm including but not limited to physical and psychological injuries, loss of wages, medical bills, future wages and medical treatment, permanent disability or even death.

Your attorney is able to prove these with the help of experts, testimony and determine how much of a settlement you require.
