Is Driving Uninsured Really That Bad?It’s not something that comes up a lot in casual conversation but when it happens to us, it’s often both a financial and legal nightmare. You might get into a vehicular accident where you’re not at fault, the other driver clearly is. Then, as you get out to start assessing the damage and wondering how much this is going to cost, the nightmare begins; the other driver admits to being uninsured.

Now this means that there’s no other insurance company to handle the damages, even though it’s not your fault. That means your own insurance company may have to front the bill, and that’s only if you decided to accept the uninsured motorist policy for yourself. If you didn’t, even your own insurance company is under no legal obligation to pay out damages.

If you decide that you want the other driver to be held responsible, you might consider going to court to sue for the damages. But most accident attorneys will provide the same advice at this juncture. If a driver doesn’t have motor insurance, odds are that it’s because he or she couldn’t afford it. And if a driver couldn’t afford even the monthly premiums for insurance, he or she is unlikely to have the financial assets required to compensate you, especially if there are injuries involved that may require medical treatment.

It’s Not An Automatic Pass

With all that going “in favor” of the person without insurance, it almost makes you wonder, what’s the point of insurance? It seems, on the surface, like the uninsured is the one with all the protection, when they have no way to meet their responsibilities. But is that really the case?

One big thing to remember is that you simply decide not to drive insured, it’s illegal. If you have any assets, a home, stocks, investments or anything else, they are vulnerable when it comes to compensation. You can hope that the lack of insurance means an accident attorney will advise a potential client to simply not pursue a lawsuit, but there’s no guarantee of that, especially if the vehicle you are in is obviously expensive.

There are also penalties that you face for driving uninsured. At the absolute minimum, if, for example, you were reported to the police as driving without insurance, or you were stopped for a speeding/parking violation and the police discovered while running a check that your car was uninsured, there will be legal consequences.

For first offenses, there is a suspension of license for up to three years unless a reinstatement fine of $150 is paid. If there are repeat offenses, the fines and suspension go up accordingly. And of course, if you are in an accident, especially if there are injuries involved, and you are at fault, you are completely financially responsible for the resultant compensation that may be required.

If you ignore license suspensions and defy requirements like getting the SR22 certificate, you may, if caught face jail time for continuing to disobey the law despite repeated attempts to keep you off the road.
