November Brings New Developments In Florida Red Light Camera Cases

Here in the Sunshine State, we have several highways and urban areas that are well known to be some of the most dangerous in the United States. Major accidents take place in metro areas like Tampa and Fort Lauderdale on a regular basis.

You might think it would be a wise idea to do anything possible to help reduce the odds of these major accidents, but it seems that some municipalities may have overstepped their due authority in the quest to make the streets safer.

Although it isn’t a “sure thing” just yet, there are several lawsuits on their way across the federal court system this November, alleging that Florida cities with red light cameras should be forced to pay back millions of dollars to hundreds of thousands of motorists.

Red Light Cameras A Double-Edged Sword?

Red light cameras might seem like a sure way to reduce speed and incentivize safe driving on tough Florida roadways. However, that’s not the way some attorneys and their clients see it.

The state of Florida receives about $83 out of every $158 fine in some jurisdictions, while the rest can remain in the hands of local communities. With recent court cases in the works, the loss of some of these funds is looking more likely.

Lawsuits contend that cities and counties may have relied improperly on the discretion of private contractors who operate the red light cameras, effectively delegating law enforcement to them. If found true, this would be a serious issue.

Just days ago, a South Florida appeals court found some merit in the possibility, saying that the city of Hollywood, Florida gave “unfettered discretion” to private personnel to issue traffic citations.

All Drivers Should Be Concerned About Florida Road Conditions

Even drivers who aren’t directly involved in the red light controversy have good reason to be concerned. Red light cameras might actually contribute to accidents in some cases.

In complex driving situations, red light cameras and other expedients can contribute to erratic or unexpected driving behavior, which might actually make accidents more likely.
