The Sad Reality of Motorcycle Accidents In Florida

Did you know that many motorists in Southwest Florida think that the motorcyclist is the one who is most responsible when there is an accident? This is a common misconception. Motorcyclists often suffer injuries and damages in an accident due to the negligence of other drivers.

And, whether they are responsible for the accident or not, they also have a much higher chance of sustaining more serious injuries and even death when involved in an accident. Motorcyclists are much more exposed and vulnerable compared to motorists in a vehicle.

Florida Traffic Crash Statistics

Approximately two percent of all Florida traffic crashes involved a motorcycle over the last several years. In 2020, there were more than 552 reported motorcycle fatalities. Overall, traffic fatalities have also increased by approximately 17 percent over the past several years, with motorcycle fatalities increasing by a staggering three percent.

Motorcycle accidents and injuries in southwest Florida occur more often during the spring and fall months when the weather is nicer. The more serious injuries occurred during March, April, and October.

Most Collisions Take Place in Intersections

Whenever you approach an intersection, care must be taken. You must watch for vehicles pulling out from driveways or side streets. Some cars may turn in front of you with no warning, and there may be parked vehicles, trees, and other obstructions that can easily block your view.

When approaching an intersection, slow down and be absolutely sure there is no oncoming traffic. You also need to be prepared to act quickly in case someone is driving carelessly around you. Some people may find it harder to spot a motorcycle.

Motorcycles Are Deadlier Than Cars

It has been reported that the death rate for those riding on a motorcycle is more than 27 times higher than the death rate for those traveling in a car or other vehicle. Motorcycles leave riders vulnerable, and there is no shield to protect them as there is in other vehicles.

However, the risk can be reduced if a motorcyclist participates in a motorcycle training course, pays attention while on the road, and wears the proper safety gear while riding.

Wearing a Helmet Reduces Your Chances of Dying

In Florida, any motorcyclist under the age of 21 must wear a helmet. According to studies done by the National Highway Traffic Safety Administration, helmets are more than 37 percent effective in preventing motorcycle deaths and 67 percent effective at preventing serious brain injuries.

Florida Tops the List for Motorcycle Fatalities

Florida is one of the states closest to the top of the list regarding motorcycle fatalities. This may be due to the warm weather since Florida offers some of the best conditions for year-round bike riding.

Seeking Compensation

If you were involved in a motorcycle accident, you might be eligible for compensation. If a biker dies through no fault of his own, there may also be grounds for a wrongful death claim under Florida's Wrongful Death Act.

Under Florida's Wrongful Death Act, the estate or personal representative of the deceased can file a lawsuit on behalf of the survivors to receive compensation for the loss of companionship, medical and funeral expenses, loss of future earnings, and the mental pain and anguish caused by losing a loved one.

Contact an Attorney

If you were involved in a motorcycle accident that resulted in death or serious injuries, then don't hesitate to contact an experienced motorcycle accident attorney in Southwest Florida. They can help identify the people responsible for the accident and hold them legally and financially responsible.

Client Testimonials

Attorney David Goldman has been exceptional in the process of helping me through the case. He has always been easy to reach, whether by phone or email, and has thorough knowledge and explains clearly in depth so you feel safe and confident in your lawyer

I used Michael Babboni and his paralegal, Nicole Moore for a legal matter. They went above and beyond my expectations. During the entire process there was constant communication with both Michael and Nicole. They were extremely organized and on top of my case, which I am very grateful for. Michael truly had my best interests at heart and he was very genuine. I plan on referring Michael to all family and friends and will continue to use him in the future.

I dealt most with Mr. Fernandez. I didn’t know a lot about this process. He took the time to speak with me individually, in person, to explain everything. It was very helpful to actually know and understand the process and what to expect. He closed my case quickly, which was nice that it was not prolonged! I appreciated his hard work and getting me what I felt I deserved after my car accident. I highly recommend him to anyone who needs an honest and reliable lawyer to assist you with your case!

I hired Mr. Walsh after an automobile accident this past March. He and his entire staff were extremely professional. They kept me informed every step of the way and settled my case in a timely manner. Thank you so much for your help.
