What To Do After A Car Crash

Getting into a car accident can have a life-changing impact for all parties involved. After ensuring your health and safety, you need to think about filing insurance claims and whether you need to prepare for legal action. To facilitate those processes and prevent complications down the line, here are some of the initial steps you can take:

Document The Accident

After ensuring your personal safety and the well-being of your passengers, it would be good to document the car accident if you are able. Effective documentation includes the following:

• Take Pictures Of the Car Crash – This should be done from different angles. Photos have to show the damage done to both cars. You can also take pictures of the license plates for your records.
• Get Information From Police Officers – Law enforcement officers who are assigned to your case will make a report of the car accident. Ask them if you obtain a copy for insurance purposes, and record their names and badge numbers as well.
• Collect Information From The Other Driver – If you are able to, exchanging contact details and insurance information with the other driver involved in the accident would help with your insurance claim. Make sure to record the other driver’s name, address, phone number, driver’s license number, license plate number, insurance company, and policy number. In case they are not the car owner, ask them for the owner’s details and find out how they are related to one another.
• Talk To Witnesses – If there were any witnesses to the accident, ask if you can take down their names and contact details.

Call Your Insurance Company

Get in touch with your insurance provider as soon as possible. Ideally, you should notify your insurer within 24 hours of the car accident. It is best not to delay this step because some insurance providers have restrictions on the amount of time they allow customers to report an accident.

You may also need to take note if your state has no-fault or fault insurance policies. In no-fault states, insurance providers can cover your medical bills to an extent. If your bills go above your insurance policy coverage, you may sue for compensation through a lawsuit if you have significant injuries.

If you live in a fault state, you may file a lawsuit on the other driver to get compensation if they do not have insurance. Note that there may be a risk of the other driver not being able to pay you if they have few personal assets. It would be good to check if your insurance policy covers accidents with uninsured motorists.

Consult With A Car Accident Lawyer

Getting compensation through insurance claims can get complicated if the fault of the accident is contested. In such cases, it may be best to hire an experienced lawyer who can help you build a strong case for just compensation.

Your lawyer can assist you in gathering and presenting documentation, and they can negotiate with the insurance company on your behalf. This can save you a lot of stress, which you do not need more of when you are recovering from an accident.

Client Testimonials

Attorney David Goldman has been exceptional in the process of helping me through the case. He has always been easy to reach, whether by phone or email, and has thorough knowledge and explains clearly in depth so you feel safe and confident in your lawyer

I used Michael Babboni and his paralegal, Nicole Moore for a legal matter. They went above and beyond my expectations. During the entire process there was constant communication with both Michael and Nicole. They were extremely organized and on top of my case, which I am very grateful for. Michael truly had my best interests at heart and he was very genuine. I plan on referring Michael to all family and friends and will continue to use him in the future.

I dealt most with Mr. Fernandez. I didn’t know a lot about this process. He took the time to speak with me individually, in person, to explain everything. It was very helpful to actually know and understand the process and what to expect. He closed my case quickly, which was nice that it was not prolonged! I appreciated his hard work and getting me what I felt I deserved after my car accident. I highly recommend him to anyone who needs an honest and reliable lawyer to assist you with your case!

I hired Mr. Walsh after an automobile accident this past March. He and his entire staff were extremely professional. They kept me informed every step of the way and settled my case in a timely manner. Thank you so much for your help.
