Filing The Paperwork

The parties involved in the case will be outlined in the petition, the legal basis for the case, the plaintiff’s claims, and any facts that may provide evidence for the claims being made. The petition is filed to notify the defendant of the case and all that it entails.

The next documents to be filed are the summons and service of process, and these notify the defendant that he or she is being brought to court on the basis of a lawsuit stemming from an accident with personal injury. These come from the court in which the case will be heard, and the defendant then has the option of filing an answer or seeking to have the case dismissed within a certain time frame. If the defendant does not reply within the time frame stated, they will then be considered “in default”, and the plaintiff will be awarded what they requested in the settlement due to the defendant’s failure to reply.

If the defendant has an answer to the plaintiff’s claims, they will then file and answer addressing each portion of the complaint. The answers that the defendant provides will either consist of admitted, denied, or insufficient knowledge, and it is at this point that the defendant may decide to file a counterclaim against the plaintiff if they, too, wish to request damages stemming from the same incident.
