The holiday season means celebration, family gatherings, and some of the busiest travel days of the year. It also brings a significant increase in serious crashes — many involving out-of-state drivers, rental cars, and uninsured motorists. With Sarasota, Bradenton, Venice, and Lakewood Ranch expecting heavy tourism for Christmas, Hanukkah, and New Year’s events, now is the time to make sure your insurance will protect you when it matters most.
Senior Partner Bernard Walsh, who has represented injured Floridians for more than four decades, shares this seasonal warning:
“The holidays bring more traffic, more distractions, and more visiting drivers. Taking ten minutes to review your coverage now can prevent a major financial loss if a crash happens.”
Below are the five most overlooked holiday coverage traps Floridians face — and how to protect yourself before you get behind the wheel.
1. Out-of-State Drivers Often Carry Coverage That Doesn’t Match Florida’s Needs
Many states require far less insurance than Florida. As a result:
- Visiting drivers may have no bodily injury coverage
- Their limits may be too low to cover your injuries
- You could be left with substantial medical expenses
This is one of the most common — and most costly — holiday-season risks on Florida roads.
2. Rental Car Insurance Isn’t as Complete as People Think
December travel means rental car lots fill up quickly, especially around SRQ, Tampa, and Fort Myers.
But most renters don’t realize:
- Many auto policies exclude UM/UIM on rental cars
- Credit card “coverage” usually applies only to vehicle damage, not injuries
- The rental counter’s optional coverage may still leave gaps
If you’re hit by an uninsured driver while using a rental, your own UM/UIM coverage may be the only meaningful protection you have.
3. “Normal” Liability Limits That Are Not Enough in a Serious Crash
Common limits such as:
- $10,000 / $20,000
- $25,000 / $50,000
are not adequate when emergency treatment, imaging, specialists, and lost wages come into play. During the holidays — with higher speeds and heavier traffic — injuries quickly exceed these amounts.
4. Rideshare Trips: The Most Misunderstood Holiday Risk
Uber and Lyft use skyrockets during Christmas events and New Year’s Eve across the Suncoast. But rideshare insurance depends on the driver’s status:
- Phase 1 – App On, No Ride: Minimal coverage; injuries often under-protected
- Phase 2 – Ride Accepted: More coverage, but still limited
- Phase 3 – Passenger in Vehicle: Rideshare liability applies, but UM/UIM is often limited or missing
Most riders believe rideshare companies automatically cover them. They don’t — especially when the at-fault driver is uninsured or underinsured. Passengers without their own UM/UIM coverage are exposed to major financial risk.
5. The One Coverage That Protects You in All These Situations
Uninsured/Underinsured Motorist (UM/UIM) coverage remains the single most important protection you can carry.
UM/UIM helps when:
- The other driver has no insurance
- Their limits are too low
- A rental driver injures you
- You’re a rideshare passenger
- A driver flees the scene
Florida has one of the highest uninsured driver rates in the country — nearly 1 in 5. Strong UM/UIM coverage is essential for year-end travel.
