All right, so what do I do if I've been in an accident? Is there a list I go by? Yes, let me give you a list. I know at the time of an accident you're probably in shock, you're in trauma, you're not thinking straight. But if you can, keep this list.
First of all, let's start with making sure everybody involved is safe, so check everybody in your vehicle. Next, get your phone.
Call the police, get them involved early to come to the scene. If the other driver is able to communicate, try to get their information about their vehicle, their insurance, and things like that. Don't apologize to anybody. If the accident is not your fault, then you shouldn't be apologizing, period. If there are eye witnesses, which they often are standing around, even though you're in shock and you're bothered and you're traumatized, please try to get their name and phone numbers. If they have any video or pictures on their phone, please ask them to send them to you. Okay? It's very important.
If you have a camera on your phone, please take some photographs if you can. I suggest to my clients, please do not go on Facebook or other forms of social media and discuss anything about the accident. The insurance companies have access to that and they'll use it against you. You have to get the damage to your car evaluated. Pick a place that you have dealt with before if you can, or go to the dealership. Save all medical bills, save all prescription costs, save everything. Your attorney will need them. If your doctor has follow-up appointments set for you, you must follow up with those appointments. Most of all, if you're dealing with the insurance company yourself, don't sign things without consulting with an attorney.
