Under Florida law, injury victims have the burden of proving a permanent injury before they can recover for pain and suffering, mental anguish, loss of quality of life for themselves and their family, to establish permanency.

Your attorney should engage expert witnesses, in other words usually medical doctors, who will be able to testify to the extent of your injuries, the treatment you received, and the need for future care. Along with how the injuries have impacted the quality of your life.

This should be covered by your experts, or in other words your medical providers. There are some exclusions to permanent injury in Florida. They include motorcycle accidents and some victims of certain types of trucking accidents, and are excluded from the requirement of permanency. You have to know your rights. You have to know Florida law.
